| Mediating in the presence of asymmetry

 What do you do, when you know that one of the parties has an unfair advantage; they are stronger, more senior, or have important information unknown to the other? How do you not compromise your neutrality?
This August event sees the anticipated return of Phillip Hart (left) and Paul Gibson. They will help you explore the issues which confront mediators when parties have asymmetries of information, status or personality, and strategies for dealing with these asymmetries.
Phillip and Paul plan a highly interactive, challenging and informative evening, with “fish-bowl” role playing, and high energy, table based discussions.
Phillip Hart
Phillip Hart helps large groups of people have constructive conversations about contentious issues. He has many years experience in a wide range of contexts in the private, public and non-government sectors in:
- communicating more effectively
- helping people get the most from difficult negotiations.
- resolving issues that have arisen amongst staff and clients
His previous conference presentations include such topics as: Conflict specialists and public confrontations, Connecting with a hostile audience and Riding the tiger: resolving complex many-party issues.
Dr Paul Gibson
For many years, as an impartial facilitator, negotiator and mediator, Paul has helped people and organisations resolve disputes. His experience and skills have helped others fundamentally change how they deal with conflict in organisations and with their communities and stakeholders. Paul has had particular experience in multi-party conflict resolution and consensus building.
As a mediator, Paul has particular experience and success in resolving commercial and contract disputes, complex technical disagreements, inter-personal conflicts, workplace grievances, industrial relations issues, sexual harassment, discrimination and workplace bullying.
One of Paul’s professional passions is in capacity building – improving the capability and capacity of individuals and organisations to manage conflict. As an educator and trainer, Paul has helped thousands of people and scores of organisations develop skills and competencies to better manage disputation, conflict arising from organisational change and the turmoil of employment relationships.
Paul is active in the education and training of dispute resolution skills. He trains and coaches mediators and is regularly asked to participate in the training and up-skilling of facilitators and conciliators. He also adjudicates the University of NSW Law Faculty Negotiation Competition, and as part of this role coaches law students in negotiation skills.
A former line manager, company director and consultant, in 2010 Paul became a co-principal of The Trillium Group with Frank Handy and Steve Lancken.
Paul’s approach as a facilitator was developed at The Tavistock Institute; he is a trained negotiator and conciliator, an NMAS Accredited Mediator and a Graded Arbitrator with IAMA.
