The trend away from joint sessions
A discussion on the increasing use of private sessions by mediators

Over the last 3 to 5 years we have seen a move away from mediators doing their work in joint session with all the parties at the table towards a process dominated by private or caucus sessions where the mediator only meets privately with the individual parties.
Some believe the purely caucus model saves time and is what the market now requires. Others believe the joint session is at the heart of what mediators do and of what mediation is.
Geoff looks at the pros and cons and posits some reasons why mediators are opting increasingly for these shuttle mediations.

About Geoff Sharp
Geoff Sharp is a commercial mediator and barrister from New Zealand. For 18 years until the late 1990s Geoff was a partner of a major NZ commercial law firm. Over the last 10 years, as a commercial mediator, Geoff has resolved many contentious matters. Geoff is regularly requested to mediate complex and hotly debated litigation covering a wide range of subject matter from insurance disputes to sexual abuse claims.
Among his many contributions to ADR, Geoff is well known for his highly stimulating, topical and entertaining blog.
Geoff is on the Advanced panel of LEADR mediators and on the AMINZ panel of specialist mediators. Geoff is also the first Australasian mediator to be elected a fellow of the International Academy of Mediators. |
