Court views on mediation

How do the NSW courts view mediation? Hear from judges, magistrates and registrars about their experience and what they see for the future. Chaired by Justice Peter McClellan, Chief Judge in the Supreme Court.

Hear the Courts' views about the extent to which parties ought to be required to undertake mediation before a hearing, and at what stage of the process?

A panel of judges, magistrates and registrars, chaired by Justice Peter McClellan, will share their thoughts and experiences and insights as to what the future holds for mediation and other alternative dispute resolution in NSW court processes.

Speakers include:

  • Justice Peter McClellan, Chief Judge, Supreme Court of NSW
  • Justice Sir Laurence Street, retired Chief Justice of NSW
  • Judge Peter Johnstone, Judge of the District Court of NSW
  • Registrar Susan Dixon, Land and Environment Court.

The panel members will present followed by time for questions from the audience.

 

Note: The NSW Chapter's Annual General Meeting and Dinner will be held on Thursday 20 November at the NSW Law Society.

 

Justice Peter McClellan has been a judge of the Supreme Court, Chief Judge of the Land and Environment Court of NSW and was sworn in as Chief Judge at Common Law in the Supreme Court of NSW in September 2005.

His Honour has also been Counsel Assisting the Maralinga Royal Commission into British Nuclear Testing in Australia (1984-85), President of the NSW Division of the National Environmental Law Association (1988-1991), and over the same period, Chairman of the State Government Inquiry into Swimming Pool safety. He has also been Acting and Assistant Commissioner of the Independent Commission Against Corruption (1992-93) and Chairman of the Sydney Water Inquiry in 1998. He has also supervised the statutory review of the Sydney Casino License (in 1997 and 2000).

Sir Laurence Street was Chief Justice and Lieutenant Governor of NSW. Since leaving the Bench he has been actively engaged in commercial mediation and has conducted over 2000 mediations principally in the field of major commercial disputes..

He is currently: Chairman of the Australian Government's International Legal Services Advisory Council and Honorary ADR Consultant to the Australian Defence Force Legal Office.
