Courts and ADR: why courts cannot and should use techniques of mediation

Andrew will examine the relationship between self determination through mediation and the rule of law. He'll follow this with a discussion of changing judicial roles with examples from overseas.

About Dr Andrew Cannon AM

Dr Cannon is Deputy Chief Magistrate and Senior Mining Warden in South Australia. He currently manages the Adelaide CBD court and therapeutic and restorative justice innovations in the criminal work of the Magistrates Court.  Andrew previously has been involved in various civil procedure reforms, including the introduction of fixed rate cost scales, court-annexed mediation, case-flow management, prelodgement final notices and diversion, court-appointed experts and improved debt collecting. 

A LEADR Accredited mediator and accredited with LEADR under the National Mediator Accreditation System, Andrew has a Masters of Laws (Honours) in Court Management and a PhD from the University of Wollongong.  He is an Adjunct Professor of Law at Westfälische Wilhems-Universität in Münster in Germany and an Adjunct Associate Professor, School of Law Flinders University.  He has published extensively on a variety of topics including therapeutic jurisprudence, family violence, ADR, civil justice reform, access to court records, comparative law, court experts, costs and more effective fact finding.   He is an author of Cannon and Kleinig, Magistrates Court Practice, Thomson Law Book, a loose leaf service for practitioners; and Cannon, Lessons from the Australian Constitution, Lit Verlag Berlin (2007).

He is a council member and board member of the Australasian Institute of Judicial Administration and is the convenor of the national education committee.
