While it is said that 'Preparation is the key to success', in fact with the wrong sort of preparation you are doomed to failure. Lawyers are skilled at preparing for litigation but what does that preparation have in common with the preparation needed for mediation? When is a well prepared litigant or lawyer at risk of crashing and burning in a mediation?
