Back to the basics!
As mediators our goal is to assist multiple parties to find their own best solutions. It is important to gather information in a fully impartial way so it is necessary to observe the parties' behaviours during the process. Being able to interpret their response accurately (direct/indirect) is the key to a successful mediation.
It is time to take a step back and look at the mediator as another party in the process. How can the mediator utilise their influence during the process to help the parties reach a satisfactory outcome while preserving relationships?
Only 7% of our communication is expressed in words, 38% is expressed through tone and 55% is expressed by our movements, actions, reactions, expressions and posture, in other words, by our body language. Are we as the mediator aware of the impact of our own tone and body language on the mediation process? Do we acknowledge the effect that our behaviour has on the process and possibly the outcome?
This paper will show how different tones and body language exhibited by the mediator can influence the mediation process and potentially the outcome. Participants in this session will be invited to take part in a variety of scenarios which demonstrate this influence.

Eduarda Abissamra
Eduarda Prestes Abissamra originally trained as a Corporate Lawyer in Brazil. Her 20 years of legal experience inspired her to train as a mediator in New Zealand where she has been living for the last six years. She strongly believes in negotiation rather than litigation as the best way to move forward.
Eduarda’s clients have found her approach to be an effective way to reach an acceptable outcome through a positive negotiation process that preserved and strengthened relationships.
Eduarda is a Certified Neuro Linguistic Practitioner, a member of the Brazilian Bar Association and an Accredited Panel Member of LEADR. She has experience in training people to run franchise business including legal and commercial protocols, as well as motivational behaviour. She is currently studying towards a Post Graduate Certificate in Commercial Law at The University of Auckland.
