Mediating an estate dispute: "where greed is not good"

About the session

Getting to an acceptable resolution in any mediation process is never

an easy task but where the subject matter involves people fighting over the spoils of a deceased's estate the degree of difficulty rises significantly.

In this session participants will gain an undertaking of the mediation process in dealing with contested wills and family provision claims.  It will explore the case histories of those disputes and demonstrate how a resolution was achieved in these cases.  It will also involve and encourage debate from the session participants on how to improve the participants' techniques in dealing with these types of disputes.

An outline of estate disputes, including contested wills, family provision claims and the superannuation pot of gold will be provided.  A description of the mediation process adopted in these cases by the presenter will be outlined.

In addition, three 'real life' case studies will be presented for discussion to be turned into a short workshop format in dealing with the issues in the cases.

Roland is an avid golfer spending as much time as his practice and his wife allows on the links.  Roland lives with his wife, Michelle and their two daughters and two boisterous poodles in Brisbane.

Roland Peterson

roland petersonRoland Peterson has practised as a Barrister at the Queensland Bar since 1983. He is an experienced trust and estate practitioner, mediator and case appraiser. A large percentage of his practice deals with litigation and mediation in the areas of wills, estates, testator’s family maintenance, trusts and equity. He has appeared as Counsel and mediator in cases to be considered. He is an approved Case Appraiser and Mediator for the Supreme and District Courts of Queensland.  He is an accredited mediator in accordance with the Australian National Mediator Accreditation System.

He is a co-author/editor of the publication “Wills, Probate and Administration Service Victoria”. He is a contributor to de Groots “Wills, Probate and Administration Practice, Queensland.” and is a member of the Society of Trust and Estate Practitioners (UK).
