Exploring the impact of the NMAS, and how it may be encouraging more than simply ending a dispute.

jimThe workshop will help participants identify the impacts of the National Standards and the opportunities they open for parties and mediators. Underpinning the National Standards is a focus on self determination and party decision making.

What is the effect of that radical change of focus on the mediator, on the parties, and on the mediation practice?

The objective of the workshop will be to examine the impact of the National Mediation Accreditation Standards (NMAS) on people and organisations in conflict and in particular on whether they allow or enable parties in dispute to achieve more than the mere ending or settlement of disputes, to explore what may be achievable beyond a settlement of disputes in terms of managing conflict.

Topics to be covered:

  • Impact the National Mediator Standards have on traditional and current mediation practices
  • What happens to people and organisations in conflict
  • How achieving settlement does not ensure the resolution of conflict
  • What lies beyond settlement and the opportunities mediation presents

The opportunities to take participants beyond resolving disputes and in supporting disputants to constructively change their conflict interactions, rebuild trust and transcend the conflict itself.

The workshop will provide a synthesis of current thinking and an opportunity for skills extension as well as providing opportunities for new understandings of the opportunities available under the National Practice Standards.

I have lived in Melbourne for most of my life.  I have a partner and three daughters. I am a longstanding St Kilda fan, and also enjoy reading, music, films and conversation.

I have been involved for over 20 years in community leadership roles and in particular as President of an Independent School for 11 years. I now sit on a number of not-for-profit boards, primarily in the role of strategic advisor.  I am currently the Victorian Chapter Chair for IAMA.

 

Jim Cyngler

Jim Cyngler is the founder of Jim Cyngler Consulting, which provides mediation, mediation training and facilitation to organisations and individuals.

Jim has conducted over 2500 mediations. Jim facilitates parties in decision making, often in complex and/or high conflict circumstances.

He helps people in conflict or dispute to evaluate and articulate their priorities and to come to a better appreciation and understanding of each other’s perspectives.

Jim is an accredited mediator with LEADR amongst many other organisations and mediates regularly across a wide range of disputes.

Jim was admitted to the Victorian Bar in 1979 and has held commercial and domestic building licences since 1986.

Jim was awarded an OAM for services to the community in 2009.
