Evaluation mediation – benefits, traps and pitfalls

Having specialist skills in the topic under dispute may contribute towards achieving an effective resolution particularly for compicated technical disputes.

steveA mediator is often chosen by the parties based on the specialist skills that the mediator brings to the mediation.

  • To what extent should a mediator use those specialist skills to assist the parties to resolution?
  • What role should experts take in mediation?
  • How should such mediation be structured?
  • What typically happens in that sort of a mediation?
  • When is the best time to mediate such disputes?

The parties will discuss various mediations in which specialist skills can be used to assist the parties solve complicated technical disputes.

This workshop will look at the findings of the American Bar Association Report in its report Task Force on Improving Mediation Quality in relation to the importance of evaluative mediation.
