LEADR’s 9th International ADR Conference 2007

19 - 21 September 2007
Wellington, New Zealand.

Wellington is New Zealand’s ‘windy city’. It sits on hills surrounding a sheltered harbour. Like the hills that protect Wellington harbour, ADR stills the tempests of conflict – thus the conference theme: Cross Winds to Calm Waters.

Collaborative practice

Lorraine Lopich writes: On 2 March 2007 the Australian Attorney-General will simultaneously launch websites for associations representing approximately 330 collaborative practitioners.

Collaborative practice is the brain child of a Minneapolis lawyer, Stu Webb. In 1990 Stu was a jaded family law practitioner who “just could not take it anymore”. Instead of retiring Stu developed collaborative practice to save his clients from soul destroying litigation and to make practising his profession fun again. Collaborative practice is about cooperation, not confrontation. It has been described as “Law without litigation / Mediation with advice”.

National and international trends in ADR

LEADR Visiting Fellow, Joanna Kalowski, addressed the LEADR Board at its annual planning meeting held in February 2007. Joanna highlighted national and international trends and the opportunities and challenges facing ADR organisations, including:

Tools for loosening the problem-story

People deep in conflict can often tell you all about how unreasonable and downright nasty is the other party. Rigid with righteous fury, they accuse, blame and denigrate. This is a very difficult position from which to resolve differences. Effective ADR requires some way of helping people relax these tightly bound problem-stories.

Powerful new tools are emerging from the “narrative” approach to mediation and counselling...

Phillip Hart shared these tools at the February NSW Network meeting, with interaction, lively discussion, case studies and practice examples.

Building and construction dispute news

As an Authorised Nominating Authority (ANA) and a provider of Adjudicators in New South Wales, Queensland and Victoria, LEADR supports and facilitates effective and independent resolution of Building and Construction Payments Disputes. To promote LEADR’s service and to assist potential claimants and respondents, LEADR’s Adjudication Case Manager, Carla Mills:

Is having published an article describing the steps that parties need to take under The Building and Construction Industry Security of Payment Act 1999 NSW in the upcoming issue of Australian Trade Contractor magazine, available March 2007.
Is presenting an evening information seminar on the same topic for the Masonry Contractors Association on 21 March 2007.

New accreditation system for Family Dispute Resolution Practitioners

The Australian Government is making significant reforms to the family law system. To promote quality service provision in line with these reforms, the Government intends to introduce a new accreditation system for family dispute resolution practitioners under the Family Law Act 1975. The Australian Government Attorney-General’s Department invited feedback on a paper it had prepared that was distributed in late 2006.

LEADR’s feedback included the need for:

Accreditation of family dispute resolution practitioners to dovetail with the proposed new standards for national accreditation of mediators
Requirements that include appropriate academic qualifications, practical and supervised training and practice, membership of a professional organisation and a commitment by the family dispute resolution practitioner that s/he will comply with standards of exemplary practice, with all legislative requirements and will continue to maintain and refine his/her practice through continuing professional learning and supervision
Flexible ways in which in which current and potential new family dispute resolution practitioners can demonstrate training and competence in the skill units for the new arrangements to be implemented from mid 2009
Appropriate levels of supervised practice and opportunities for continuing professional development.

Updated 4 day Mediation Workshop materials

Thank you to LEADR Lead Trainers for time spent in late January, meeting with LEADR CEO, Fiona Hollier, to review and update LEADR 4 Day Mediation Workshop materials. Our Lead Trainers Tania Sourdin, Nina Harding, Bradley Chenoweth and Anne Sutherland-Kelly are all in high demand as mediators, facilitators and educators. That they made this time available is testament to their commitment to LEADR and to delivering a high quality and current product. As well as updated materials, the LEADR office has developed a new look for both the powerpoint slide presentation and the workbook.

 

LEADR staff on the move

Farewell ... After two and a half years as LEADR’s Mediation Case Manager, Anh Kim Tran has moved on. Anh was keen to find a role where she could put her recently gained Accountancy degree to use. “I have really enjoyed my time working with LEADR. I am sad to be leaving and will miss the staff and all the LEADR members who I have worked with.” LEADR will miss Anh. We have appreciated her conscientious and collaborative approach and her commitment to doing a good job. We wish her well in all her future endeavours.

Welcome back … to LEADR Office Manager, Therese Skinner. Therese has spent the last 6 weeks travelling in South America and to Antarctica, returning from this “fabulous once-in-a lifetime experience”, with a host of unforgettable stories. LEADR is thrilled that Therese has had such a wonderful and well-earned holiday, and very pleased that she is back.

If these criticisms can be addressed, the process offers to disputants the prospect of knowing the dispute will be resolved; giving mediation their best shot; and saving time and money.
