LEADR’s recent survey – which received an exceptional 409 responses from across Australia and New Zealand – reflects a strong alignment with LEADR’s current priorities. Highlights from the LEADR’s Conference in Wellington
LEADR's 9th International ADR conference held in Wellington in early September was a great success. Congratulations to New Zealand! Over 120 delegates enjoyed the networking and rich knowledge and experience sharing.
We are delighted to bring you four of the talks in this issue of Update and another four in the next issue. Papers from the conference will be available we'll keep you posted where and when.
Mediation and the meaning of life
David Hoffman has referred to psychiatrist Victor Frank's belief that the need for life to have meaning is the deepest strongest yearning. Applying this view to mediation involves mediators being aware that ‘meaning' is one of the fundamental interests a party brings to the table. More info for LEADR members >>
David Hoffman is the founder of the Boston Law Collaborative and a mediator, arbitrator and lawyer. A senior commercial, business and family lawyer, David teaches the mediation course at Harvard Law School and is also a collaborative law trainer and member of the International Academy of Collaborative Professionals (IACP).
Marketing and sales: a mediator's natural skill-set
As mediators we really don't like marketing and selling ourselves – don't like the concept, don't like the activity, feel it's just 'not me'; we want to avoid it at all costs ... and procrastinate. Bill Rainey is a director of Concordia, an innovative conflict management business started in NZ in 2002 and which now has a global spread. Having recently cut his safety line to the legal profession, Bill works with Concordia in NZ, UK, Ireland, Europe and SE Asia.
Community collaboration through mediation and facilitation
The potential of mediation and facilitation to resolve issues and build community resources is largely unexplored. The challenge is to demonstrate the potential benefits of building collaborative relationships between apparently divided interests as a new way of communities working together, to provide them with a process and the strength to shape a positive and healthy future. Tim Clarke and Sharon Stewart have over 30 years combined experience in communication and conflict management. Both qualified lawyers, they have chosen to work primarily in ADR. Whether in mediation or an ongoing consultancy, their approach is to assist parties to develop the skills and capacity necessary to resolve issues for themselves. Tools for loosening the problem-story
Rigid with righteous fury, people deep in conflict accuse, blame and denigrate the other party. Effective ADR requires some way of helping people relax these tightly bound problem-stories. Phillip Hart specialises in mediation, facilitation and workplace education. He has many years experience in a wide range of contexts in the private, public and non-government sectors in: resolving issues that have arisen amongst staff and with clients; communicating more effectively; and helping people get the most from difficult negotiations.
Native title mediations from a mediator's perspective
Bardy McFarlane, member of the National Native Title Tribunal (the Tribunal) shared his insight into native title mediations with the SA Chapter in September.
The Native Title Act 1993 (the Act) emphasises agreement-making as the preferred means of resolving native title issues, and established the Tribunal to, among other things, mediate native title applications.
In the years since the Act commenced, the Tribunal has developed a practice for mediating native title matters (primarily claimant applications) in ways that take into account the many special circumstances in which parties try to negotiate agreements. More info for LEADR members >>
Where is the magic in mediation?
In his article “Mediation – where is the Magic...?” Fergus Armstrong contemplates the current state of commercial mediation in Ireland, the courts' readiness to refer, lawyers’ conflicting views of the value of mediation, and the challenges faced for those committed to the practice of mediation. Fergus Armstrong is a CEDR accredited full time mediator. He is a lawyer, and consults to McCann Fitzgerald where he was formerly Chair. Fergus principally mediates commercial disputes and has also mediated and facilitated for the Catholic Church in Dublin.
"Everything you say will remain confidential..."
Another note on the decision in Brown v Rice & Patel [2007] EWHC 625 (Ch), written from the perspective of an English barrister. David Owen QC comments that the typical English mediator’s introduction to a mediation may not go far enough given comments made by the bench in Brown’s case. More info for LEADR members >>
David is a barrister with over twenty years experience of commercial disputes. He specialises in complex contractual disputes. David is a CEDR accredited mediator and member of the CEDRSolve panel. He also Chairs a charity which provides community mediation in South London.
ADR as used by the NSW Land and Environment Court
At the NSW Chapter annual dinner on 15 November, The Honourable Justice Brian Preston, Chief Judge of the NSW Land and Environment Court, will speak about alternative dispute resolution particularly as used by the Court.
The Land and Environment Court offers a range of ADR services including mediation (either in-house or external), conciliation conferences (by commissioners) as well as early neutral evaluation (by commissioners or external) to assist the parties to resolve planning and other disputes without a formal hearing. CEDR relaunches its website
The Centre for Effective Dispute Resolution (CEDR), the UK-based, not-for-profit organisation, has relaunched its website providing an excellent on-line resource for conflict management, resolution and training. The re-launched website encompasses each of CEDR’s services for the first time under one banner: www.cedr.com. A free registration gives you access to downloadable reports and papers and signs you up for CEDR e-bulletins.
